GRIEVANCE PROCEDURE
Revised grievance and arbitration procedure consistent with the American Arbitration Association.
BONA FIDE PRODUCTION EMPLOYER (BFPE)
The parties revised the BFPE provisions to further clarify that BFPE terms and conditions can only be shared by a signatory BFPE company with another company who is also signatory and BFPE. Otherwise, the non-signatory company will be subject to the non-BFPE terms and conditions.
ALTERNATIVE DISPUTE RESOLUTION
The Agreements include a new sideletter authorizing Employers to require employees to execute a Union-approved arbitration agreement as a condition of employment. The arbitration agreement is limited to wage-and-hour disputes and preserves employees' rights to pursue claims before government agencies. (Note that this form is different from the template arbitration agreement currently on the AICP website).
