Wrap-Up Insurance Sample Form Letter to Agency
On February 14th, 2024 AICP held a town hall on the existence of an employee injury exclusion in some agency/advertiser wrap-up excess liability policies. During this town hall AICP members were advised to contact the wrap-up broker when awarded a job to ask if the wrap-up excess liability policy contains an employee injury exclusion. If the wrap-up excess liability policy contains this exclusion, you may want to send a letter to the wrap-up broker and the agency or advertiser explaining the necessity for removing this employee injury exclusion from their wrap-up excess liability policy.

On May 15th, 2025, AICP held a town hall on the primary and noncontributory status of some agency/advertiser wrap-up policies. The wrap-up program is intended to be the primary insurance that protects the production company on wrap-up insured jobs. Recently a wrap-up insurance carrier interpreted their policy to mean that the claim should be shared with the production company on a 50/50 basis, even though the agency or advertiser had contractually agreed to provide insurance on a primary noncontributory basis as outlined in the insurance addendum. During this town hall AICP members were advised to contact the wrap-up broker when awarded a job to request a primary and noncontributory endorsement to the wrap up policies.

On July 10, 2025, AICP held a town hall on wrap-up insurance deductibles and the obligation of the agency/advertiser to reimburse members for covered claims that fall under the deductible amount in accordance with the wrap-up insurance addendum. During this town hall AICP members were advised to ask the wrap-up broker to have the claim adjusted by the insurance carrier and provide a copy of the claim adjuster’s report to the member. Claims determined by the insurance carrier adjuster to be “covered but under the deductible” are the obligation of the agency/advertiser and the AICP member should reimbursed for the amount of the claim.

On February 6, 2025, AICP held a virtual town hall on liability policies and how they vary depending on the country where the policies are issued. The discussion covered the shortcomings of some liability insurance programs, coverage differences between countries, and how the production company can protect itself from being uninsured.
